RNG Performance (RedNeck Garage LLC)

These Terms and Conditions of Sale (“Terms”) govern all purchases made from RedNeck Garage LLC d/b/a RNG Performance (“Seller,” “we,” “us,” or “our”). By placing an order, Customer agrees to be bound by these Terms.

By placing an order through our website, by phone, by email, or in person, Customer:

• Represents that they have read and understand these Terms;
   
• Agrees that these Terms form a binding contract; and
   
• Agrees that no additional or inconsistent terms shall apply unless expressly agreed to in writing by Seller.
   

All orders are subject to acceptance by Seller. Seller reserves the right to refuse or cancel any order at its sole discretion prior to shipment.

Once order processing has begun, cancellations are not permitted except with Seller’s written approval.

Approved cancellations are subject to a minimum twenty-five percent (25%) cancellation/restocking fee.

All prices are subject to change without notice prior to order confirmation.

Customer is responsible for:

• All shipping charges
   
• Oversized freight charges
   
• International tariffs, duties, and import fees
   
• Any carrier surcharges
   

Shipping charges are non-refundable.

All goods are sold FOB Shipping Point.

Pursuant to the Uniform Commercial Code as adopted in Ohio:

• Title and risk of loss transfer to Customer at the time Seller delivers the goods to the carrier.
   
• Seller’s responsibility for the goods ceases upon tender of the shipment to the carrier in good condition.
   

Seller shall not be liable for:

• Loss in transit
   
• Theft after shipment
   
• Carrier delay
   
• Carrier damage
   
• Failed delivery attempts
   
• Misdelivery due to incorrect address provided by Customer
   

Customer is solely responsible for monitoring tracking information and coordinating delivery.

Seller may offer optional shipping protection at additional cost.

If Customer elects additional protection:

• Customer must file a claim directly with the carrier.
   
• Any insurance proceeds paid by the carrier shall be payable to Seller.
   
• Seller will replace goods only after claim approval and receipt of carrier funds.
   
• Replacement is limited to the insured value selected at checkout.
   

If Customer declines additional shipping protection, Seller does not guarantee replacement for carrier-related loss or damage.

Customer must inspect all goods immediately upon receipt.

Any claim for visible shipping damage must be reported to Seller within twenty-four (24) hours of delivery and must include photographic documentation of:

• The product
   
• The packaging
   
• The shipping label
   

Customer is responsible for initiating and pursuing all carrier claims.

Minor cosmetic imperfections not affecting functionality shall not constitute grounds for replacement or refund.

Returns are accepted only for products determined by Seller, in its sole reasonable discretion, to be defective.

Conditions:

• Return request must be made within thirty (30) days of delivery.
   
• Return authorization must be obtained prior to shipment.
   
• Customer is responsible for return shipping.
   
• Shipping charges are non-refundable.
   

Returned products must be:

• In original packaging
   
• Complete with all parts
   
• Not abused, modified, or improperly installed
   

All returned items will be inspected prior to determination.

If deemed defective, Seller may, at its sole option:

• Repair
   
• Replace
   
• Issue refund to original payment method
• 
   

The following items are non-returnable and non-cancelable unless required by law:

• Electrical components
   
• Clutch components and CVT belts
   
• OEM parts
   
• Performance parts
   
• Clearance or discontinued items
   
• Special order or custom items
   
• 
  

If Seller approves a return for reasons other than defect:

• A minimum twenty-five percent (25%) restocking fee applies.
   
• Customer is responsible for all shipping costs.
   
• Refunds are issued only after inspection and approval.
• 
   

Backordered or pre-sale items may experience extended delays.

Estimated arrival dates are not guaranteed.

Such items may not be canceled within ninety (90) days of purchase without Seller approval. Approved cancellations are subject to a 25% fee.

If goods have not shipped within ninety (90) days of purchase, Customer may request a full refund without restocking fee.

If Customer fails to respond to contact attempts regarding returned merchandise or undeliverable shipments within thirty (30) days:

• Property may be deemed abandoned.
   
• Seller may dispose of the property without further notice.
   
• No refund shall be issued.
   
• Storage fees may accrue at $10 per day after the 30-day period.
• 
   

Unless otherwise required by law:

• Aftermarket product warranties are limited to manufacturer warranties.
   
• OEM parts are warranted for thirty (30) days against manufacturer defects only.
   
• Wear items including clutch components, lift kits, and wheel spacers carry no warranty unless provided by manufacturer.
   

EXCEPT AS EXPRESSLY STATED, SELLER DISCLAIMS ALL IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, TO THE MAXIMUM EXTENT PERMITTED BY LAW.

To the fullest extent permitted by law:

Seller’s total liability shall not exceed the purchase price of the product.

Seller shall not be liable for:

• Incidental damages
   
• Consequential damages
   
• Lost profits
   
• Loss of use
   
• Installation costs
   
• Labor costs
   
• Towing or transportation costs
   
• 
  

Customer agrees to contact Seller to resolve disputes prior to initiating a chargeback.

Seller reserves the right to dispute fraudulent chargebacks using order confirmations, IP data, shipping confirmation, and delivery records.

These Terms shall be governed by the laws of the State of Ohio.

Any dispute shall be brought exclusively in a court of competent jurisdiction located in Stark County, Ohio.

If any provision is found unenforceable, the remaining provisions shall remain in full force and effect.
